Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and DNScale OÜ, a company registered in Estonia at Harju maakond, Tallinn, Lasnamäe linnaosa, Sepapaja tn 6, 15551 ("Company," "we," "us," or "our"), concerning your access to and use of our DNS management services.

2. Description of Services

DNScale provides managed DNS services including:

• DNS zone management and hosting
• DNS record management (A, AAAA, CNAME, MX, TXT, etc.)
• DNSSEC implementation and management
• API access for automated DNS management
• Global and EU-specific DNS infrastructure

3. Account Registration

To use our services, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or have legal capacity to enter contracts
• Comply with all applicable laws and regulations

4. Acceptable Use Policy

You agree not to use our services for:

• Illegal activities or violation of any laws
• Distributing malware, spam, or harmful content
• Interfering with or disrupting our services
• Attempting unauthorized access to our systems
• Violating intellectual property rights
• Activities that could harm our reputation or operations

5. Service Levels and Availability

We strive to maintain high service availability but do not guarantee uninterrupted service. Our Service Level Agreement includes:

• 99.99% uptime target for DNS resolution
• Scheduled maintenance windows with advance notice
• Emergency maintenance as required for security or stability

6. Pricing and Payment

Payment terms:

• Fees are charged in advance on a monthly or annual basis
• All prices are in Euros and include applicable VAT
• Payment is due within 14 days of invoice date
• We may suspend services for non-payment after 30 days
• Refunds are provided according to our refund policy

7. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms. We comply with applicable data protection laws, including the GDPR.

8. Intellectual Property

The DNScale platform, including software, designs, and content, is owned by DNScale OÜ and protected by intellectual property laws. You retain ownership of your DNS data and configurations.

9. Limitation of Liability

To the maximum extent permitted by law, DNScale OÜ shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate this agreement:

• With 30 days written notice for convenience
• Immediately for material breach of these Terms
• We may suspend services immediately for security reasons

11. Governing Law

These Terms are governed by Estonian law. Any disputes shall be resolved in the courts of Estonia. EU consumers may also bring proceedings in their country of residence.
